Who collects information

Surveyhills collects information which assists companies in developing new products and services. When you are on Surveyhills site and are asked for personal information, you are sharing that information with Surveyhills alone, unless it is specifically stated. If data is being collected and/or maintained by any company other than Surveyhills, you will be notified prior to the time of the data collection or transfer. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Any sensitive information (i.e. personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual) will be treated with additional care. If Surveyhills intends to disclose such information to a third party or use it for a different purpose than originally collected, then you will be expressly asked permission prior to any such disclosure.

Personal information collection

Surveyhills collects information in several ways. Some personal information is gathered when you voluntarily to register with us. During registration, Surveyhills asks for your name, email address, zip code, household information and personal interests,etc. The more information you provide to us (and the more accurate it is), the better we are able to customize your experience. After the registration, you are given an account number and become a member of Surveyhills panel. You are eligible to some of our services.

Cookie

We may use technology to track the patterns of behaviour of visitors to the Site. This can include using a "cookie". A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. The cookies function by saving your passwords and webpage preferences (including those preferences for the Website). As a result it is possible to speed up your future activities at the site and allow Surveyhills to provide you with information specifically tailored to your interests. You can usually modify your browser to prevent this happening.

Purpose of collecting information

l  To keep you informed and obtain your views of Surveyhills's products, services and activities.

l  The creation of a database of individuals willing to take part in research and surveys, and evaluating which individuals registered with us should be approached in respect of surveys being conducted.

l  Contacting you by email to invite you to take part in surveys, and, undertaking research surveys on behalf of third parties.

l  To provide you with information about benefits given to you by Surveyhills or any third party as a result of your responding to survey requests.

l  Processing the answers to surveys and summarising the results.

l  Transferring to service suppliers who undertake processing on our behalf and at our direction.

l  Permitting third party research organisations to question on individuals registered with Surveyhills in respect of surveys.

l  Statutory and regulatory compliance.

l  To transfer to third parties, on your permission, who provide services to Surveyhills or provide benefits to participants in Surveyhills panels.

Information Share

As a general rule, Surveyhills will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. The following describes some of the ways that your information may be disclosed.

Business Partners and Sponsors: Surveyhills may disclose your personal information to business partners or sponsors, but this is specifically described to you prior to data collection or prior to transferring the data. If any personal data about were ever to be shared, we will tell you before we collect or transfer the data.

From time to time, you may be offered the opportunity to receive materials or special offers from third parties. If you opt in to receive information from these third parties, Surveyhills will (with your permission) share your name and email address with them.

Other: Surveyhills may also disclose account information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating Surveyhills's Terms of Use or may be causing injury to or interference with (either intentionally or unintentionally) Surveyhills's rights or property, other Surveyhills users, or anyone else that could be harmed by such activities. Surveyhills may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.

What security precautions are in place to protect the loss, misuse, or alteration of my information?

Your account information and profile are password-protected so that you and only you have access to this personal information.

We recommend that you do not divulge your password to anyone. Surveyhills will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also remember to sign out of your account and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.

Whenever Surveyhills handles personal information as described above, regardless of where this occurs, Surveyhills takes steps to ensure that your information is treated securely and in accordance with the relevant Terms of Use and this Privacy Policy.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Surveyhills cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.

These Terms of Use describe the terms and conditions applicable to your use of Survey Hills services. You should read it, understand it, and review it periodically for updates. If you have any questions that our FAQ cannot answer, please contact us.

1 Use of this website and the contract between us
1.1 Once you have submitted your answers to our joining questionnaire you become a member of the Survey Hills Panel.
1.2 You agree to only use this website in accordance with this agreement and all applicable laws.
1.3 The offer by Survey Hills to take part in surveys, research and your acceptance of that offer by providing the information that we request, brings into existence a legally binding contract between us.
1.4 This agreement is a contract for the provision of services and nothing in this agreement shall create or be deemed to create a legal partnership or the relationship of agent and principal or the relationship of employer and employee between you and the Company. 

2 Obligations of Survey Hills
2.1 Survey Hills shall:
2.1.1 consider your eligibility to take part in each of its surveys; There is no obligation on Survey Hills to select any panel member to answer survey. The members requested to take part in surveys depends on the requirements of the clients of Survey Hills and the random selection of those that are eligible.

2.1.2 credit the relevant amount to your account each time you correctly and completely answer all of the questions in a survey.

2.2 Survey Hills reserves the right to:
2.2.1 offer a substitute reward of equivalent value to the payment method you have selected; and change the value of the nominated amount in respect of answering survey and research questions.
2.2.2 Survey Hills does not credit your account if you fail to meet any of Clauses 3.1.5/3.1.6below. And that you fail to meet Clauses 3.1.5/ 3.1.6 below after crediting your account, Survey Hills may deduct from your account any nominated amounts credited in respect of all relevant surveys.

2.2.3 Survey Hills may cancel or invalidate your eligibility, accounts, registrations and points, deny redemption of points, or restrict, block, limit, and prevent your access to and use of the services and, further, all points, incentives and rewards shall be subject to forfeiture if fail to meet the clause 3.1.1-3.1.4 below.

2.3 Survey Hills shall not be obliged to make any payment to a member:
2.3.1 whose balance in their Survey Hills account does not reach the minimum amount of the reward;

2.3.2 who terminates their membership of the Survey Hills Panel prior to the balance of their Survey Hills account reaching the level of the reward.

2.3.3 Who fail to meet any of clause 3.1.1-3.1.6 below.

3 Obligations of the member
3.1.1 The Services may be used only by persons who are at least 14 years of age.

3.1.2 All information you provide when completing our register questionnaire are true, has no fraud or other inappropriate activities.
3.1.3 You shall not register with Survey Hills more than once;
3.1.4 You will not attempt to answer a survey more than once, either by using more than one name or more than one email address to enter into a survey;
3.1.5 You will be honest in your approach to the research, for example you will not provide confusing or meaningless answers.

3.1.6 The time use of answering a survey is shorter than a reasonable average time spending.

3.2 Survey Hills has no obligation in respect of any tax due on the reward given to a member and the member shall be responsible for declaring any income received from Survey Hills under this agreement.


4 Termination
4.1 Survey Hills may terminate your membership of the Survey Hills Panel:
4.2 You can terminate this agreement at any time by unsubscribing from the Survey Hills Panel, this can be done by email, telephone or in writing. The termination will take effect 14 business days after the receipt of your notice.

 
5 Intellectual Property Rights
The services and other materials contained on the website or within the Services, including, without limitation, the Survey Hills marks, logos, and all information, content, designs, text, graphics, information, data, software, other files, and arrangement are the property of Survey Hills.
Under this agreement, Survey Hills grants you a limited, revocable, non-transferable rights to access and use the services, solely for your personal, non-commercial purposes. Any use of the services or any content other than as specifically authorized in this agreement, without the prior written permission of Survey Hills is strictly prohibited. Unauthorized use may also violate applicable laws and regulations, including, without limitation, copyright and trademark laws and applicable communications regulations and statutes, and the rights of Survey Hills and of third parties.

6 Limitation on Liability

Neither Survey Hills nor any other providers will be liable for any indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damagers for loss of profits, goodwill, use, data, or other intangible losses.(even we have been advised of the possibility of these damages), resulting from your access to or use of, or your inability to access or use, the services or any content. Some jurisdictions don’t allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you

Disclaimer of Warranty
7.1 Separate terms and conditions may apply to certain products, services and materials available through this website. If this is the case this will be brought to your attention. Subject to this, no express or implied warranties of any kind are made in respect of this website or the products, services and materials available through it.
7.2 Survey Hills does not warrant that this website will operate uninterrupted or error/virus free or that the information on this website is accurate or complete.

8 Data Protection
8.1 Survey Hills may collect registration data and obtain other information about you through the Services. Any personal information you submit to Survey Hills will be dealt with in accordance with our Privacy Policy.

9 Updates to the Terms of Use Policy
9.1 Survey Hills may update this agreement from time to time. This may lead to changes in this Agreement. You are responsible for reviewing and adhering to the most recent update of this Agreement. and your subsequent use of this website will be deemed to signify your acceptance to the changes. 

10 Links to Other Companies or Organisations
10.1 The Survey Hills website provides web-links (and other contact details) to other websites that offer products, services and materials we think will be of interest to you. Some of these websites are operated in conjunction with other companies/organisations and some are operated solely by independent companies/organisations. Survey Hills accepts no liability for any products, services, materials or information contained on or available through linked websites or otherwise provided by any other company/organisation referred to on this website. No linked websites are covered by this agreement, therefore, you should check what terms cover the use of these websites before using them.
10.2 You may only link to this website with our prior written permission. Survey Hills reserves the right to remove any links to its website that it deems are inappropriate without notice.


11. General legal notice

By accessing or using these services, you consent to receiving electronic communications from Survey Hills. These communications may include notices about your account and information concerning or related to the services. You agree that any notices, agreements, disclosures, or other communications that Survey Hills sends to you electronically will satisfy any legal communication requirements, including any requirement that communications be in writing.
Survey Hills’s failure to act in a particular circumstance does not waive its ability to act with respect to that circumstance or similar circumstances. Any provision of this agreement that is found to be invalid, unlawful, or unenforceable will be severed from this agreement, and the remaining provisions of this agreement will continue to be in full force and effect. The section headings and titles in this agreement are for convenience only and have no legal or contractual effect. Any provisions in this agreement that by their nature should survive the termination of this agreement (including, without limitation, provisions governing indemnification, limitations on liability, disclaimers of warranty, and ownership of intellectual property) will continue to remain in full force and effect after the termination of this agreement.
This agreement is governed by the laws of China, excluding conflicts of law principles. Any controversy or claim arising out of or relating to the services or this agreement must be commenced within one year after the claim arose and will be settled by binding arbitration in accordance with the commercial arbitration rules of the China Arbitration Association. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration will be conducted in Shanghai, China.

This agreement, including all terms, policies, and guidelines referenced in this agreement, is the entire agreement between you and Survey Hills concerning the services. This agreement supersedes all prior agreements or communications between you and Survey Hills regarding the subject matter of this agreement.
